Tony, a Vietnam Vet, was treated at a VA hospital for a tumor on his face that was found to be cancerous. It was successfully removed. A few years later, in May 2013, Tony got another tumor on a different part of his face, just in front of his right earlobe. He was referred to Dr. Joseph Payne to remove it.
Dr. Payne biopsied it and found it to be cancerous. This medical malpractice case deals with that May 2013 right-earlobe tumor.
Dr. Payne excised the tumor and…. And by his own admission, discovered something called “perineural invasion.” Perineural invasion is a major red flag in any cancer diagnoses.
Tony, being a Vietnam vet had been exposed to Agent Orange in Vietnam, and was a high-risk patient with a high-risk tumor, but Dr. Payne did not consult an expert dermato-pathologist to make sure he had spotted all the perineural invasion.
In fact, Dr. Payne did “NOT” inform Tony about the seriousness of his cancer, nor did he consult an oncologist, or refer Tony to one for further evaluation.
Tony did have cancer in his face. In fact, Tony’s condition got so bad, surgeons had to cut off must of his ear, and a chunk of the right side of his face, to grind away part of his skull. Because one doctor, Dr. Joseph Payne chose to play Russian roulette with Tony’s life….. This is Tony Waldrop’s story and his pending legal case for medical malpractice, against Dr. Joseph Payne
