In theory, guardians or conservators are court appointed qualified professionals who are supposed to act in the best interests to care for people, who can no longer care for themselves, usually due to diminished mental capacity from aging.

Guardians have almost “Absolute power”. They decide where the ward lives, how money is spent and invested, who can see the ward, medical decisions, and more. Guardians have a duty to act in their wards’ best interests.”

And that’s all good…In theory. But human nature being human nature, sometimes that “Absolute Power”, “Corrupts Absolutely”, some of these guardians and their lawyers, so that the best interests of their ward are not properly or legally represented by them.

In the United States, a million and a half adults are under the care of guardians, either family members or professionals, who control some $273 Billion dollars in assets, and the question arises, “Who’s Guarding Against the Guardians”?

Little is known about the outcome of these arrangements, because states do not keep complete figures on guardianship cases—statutes vary widely—and, in most jurisdictions, the court records are sealed.

A study published this year by the American Bar Association found that “an unknown number of adults languish under guardianship” when they no longer need it, or never did. The study stated that “guardianship is generally “permanent, leaving no way out, ‘until death do us part.’ ”
