The Constitution is not self-executing. It is given life and sustained by our institutions of government, by checks and balances so as not to become the tyranny we overthrew in our revolution.
James Madison said, “the people are the only legitimate fountain of power, and it is from them that the constitutional charter, under which the several branches of government hold their power, is derived.”
And Alexander Hamilton observed that “The purpose of government is to promote the general welfare.”
In short, laws and regulations serve as the backbone of a well-functioning society, ensuring order, stability, and the protection of individual rights and the common good. In the U.S., regulations play a vital role in various aspects of life, including governance, the economy, public safety, and the protection of individual rights. The United States—like virtually all modern societies—is a nation of laws.
What’s clear is that our founders believed government has a role to play in protecting the people, promoting the general welfare, and ensuring that the government is able to function effectively. Regulation is a tool to achieve these goals.
