Although Federal and State authorities have attempted to outlaw certain chemicals and their analogs and to remove these items from commerce, their efforts continue to fall short as the chemists and producers providing the products for head shops simply alter formulas and stay ahead of the legislation.
“There is clearly a regulatory gap,” the U.S. Attorney’s Office in Los Angeles has stated. While it is a violation of law to inhale nitrous oxide in order to get high, there is no law on the books making it a crime to sell nitrous oxide to buyers who intend to inhale the substance. However, tobacco shops – which clearly run establishments selling products intended for inhalation – are making thousands of dollars off the sale of nitrous oxide for that very purpose.
And these products are being sold without any indication of the truly dire consequences of their use. While they state, “Do not inhale,” they do not indicate the significant health risks, nor do they indicate that these products will create serious impairment to driving ability.
Defendants are hotly contesting this lawsuit. The head shops are refusing to produce any evidence or admit that they have any documents that show they have sold these products or how much money they have made off their sale, claiming these documents have been destroyed.
While the New York Attorney General has gone after sellers of nitrous oxide to stop the sale of this hazardous material for inhalation, California’s Attorney General has refused to pursue those stores selling nitrous oxide chargers. Los Angeles authorities have started pursuing people selling nitrous oxide for an illegal purpose, but no one in Northern California is making any attempt to curtail its use.
