It is as vitally important today as when it was enacted. It provides protection against an overzealous government, and seeks to balance the interests of the government with that of the people to be free of unreasonable conduct.

This case is unique because it involves missing evidence and a district court unwilling to hear the case. It also involves an American with disabilities.The case has the potential to make significant impact in the lives of low-income New Mexicans, and the lives of all Americans with disabilities, when they attempt to access justice or otherwise enforce their guaranteed rights through the courts.

As Derek has often said….. “the problem of Police Brutality is much more widespread than most Americans are willing to admit. …….Our nation practices….. a selective blindness…In this great and strong nation, we have all become unwitting accomplices to the continuation of the conflict”.
